CLP Regulation 1272/2008 contains, in its Annex VI, the list of harmonised classification and labelling of hazardous substances (CLH). Thanks to the progress of knowledge, the CLH list is regularly updated through Adaptations to Technical Progress (ATP) amending Regulations.
Communication of changes related to the substances of concern, and their impact on downstream mixtures shall be closely followed. Here are the coming deadlines:
What’s New in ATP 22?
Regulation (EU) 2024/2564 applies to 50 substances, among which:
- 27 are new entries:
- Sodium peroxoborate and their hydrates (9 variants); sodium peroxometaborate;
- Multi-walled carbon tubes, nano or not;
- copper [with specific surface area > 0,67 mm2/mg];
- Silver, massive, powder or nano;
- reaction mass of 1,3-dioxan-5-ol and 1,3-dioxolan-4-ylmethanol;
- α-methyl-1,3-benzodioxole-5-propionaldehyde (3 isomers);
- di or trimethylcyclohex-3-ene-1-carbaldehyde (16 isomers);
- acetone oxime;
- (3E)-dec-3-en-2-one ;
- 2-(dimethylamino)-2-[(4-methylphenyl)methyl]-1-[4-(morpholin-4-yl)phenyl]butan-1-one ;
- 2,3-epoxypropyl neodecanoate ;
- benthiavalicarb-isopropyl ;
- hexyl salicylate;
- 7-oxabicyclo[4.1.0]hept-3-ylmethyl 7-oxabicyclo[4.1.0]heptane-3-carboxylate;
- tetrasodium 4-amino-5-hydroxy-3,6-bis[[4-[[2-(sulphoonatooxy)ethyl]sulphonyl]phenyl]azo]naphthalene-2,7-disulphonate (3 variants);
- Sodium 3-(allyloxy)-2-hydroxypropanesulphonate;
- 1,4-dichloro-2-nitrobenzene;
- 2-[ethyl[3-methyl-4-[(5-nitrothiazol-2-yl)azo]phenyl]amino]ethanol;
- Fenpropidin;
- 1H-benzotriazole; methyl-1H-benzotriazole;
- N,N'-methylenediacrylamide;
- tert-butyl 2-ethylperoxyhexanoate;
- 16 were updated:
- trimethyl borate;
- ethanethiol;
- sulfur;
- copper flakes (coated with aliphatic acid);
- n-hexane;
- biphenyl-2-ol;
- formaldehyde solutions;
- formic acid solutions;
- dicamba;
- peracetic acid solutions;
- propyl 3,4,5-trihydroxybenzoate;
- glyphosate;
- S-metolachlor;
- Pyraclostrobin;
- reaction mass of N,N'-ethane-1,2-diylbis(decanamide) and 12-hydroxy-N-[2-[(1-oxodecyl)amino]ethyl]octadecanamide with or without N,N'-ethane-1,2-diylbis(12-hydroxyocctadecanamide);
- dibenzoyl peroxide;
- And 7 are deleted
- Sodium per(oxo)(meta)borate, whatever the content of particles < 50 µm (2 entries);
- Perboric acid sodium salt (6 variants) , whatever the content of particles < 50 µm (4 entries);
- Granulated copper.
These provisions shall apply from 1 May 2026, end of transitional period.

Preparing for ATP 23 Updates
The next set of changes was published in June 2025; it contains 22 new and 10 updated entries.

These classifications already apply, but the transitional period for selling existing stocks and organising the classification obligations ends on 01 February 2027.
These CLH are of mandatory application for the harmonised hazard classes, and can be completed by a self-classification, where relevant and reliable data is available, for the non-harmonised hazards. As an example, a substance with a CLH for skin irritation, can be additionally self-classified for acute oral toxicity, or for toxicity to the aquatic environment. But irritation cannot be turned to skin corrosion without an update of the CLH.
Anticipation is key, as a CLH update does not only involve revamping labels, but also the classification of related mixtures, for yourself or your downstream users, revision of SDS, and possibly other heavy related consequences on transport provisions, or even questioning on market positioning.
