SME Verification Changes from 2027
The European Chemicals Agency (ECHA) has confirmed an important procedural change that will affect companies claiming Small and Medium-sized Enterprise (SME) status under EU REACH.
From 5 February 2027, companies must obtain official SME recognition before submitting a REACH registration or authorisation dossier if they wish to benefit from reduced fees.
For non-EU manufacturers appointing an Only Representative (OR), and for companies planning new EU REACH registrations, this change introduces a critical new planning step.
Non-EU Manufacturers & EU REACH Registrants Need to Prepare
Under the EU REACH Regulation, SMEs benefit from significantly reduced registration and authorisation fees. Until now, SME status has typically been verified after dossier submission.
From February 2027, this will change to a mandatory ex-ante verification system introduced by ECHA.
- SME recognition must be obtained before dossier submission.
- The application for SME verification must be submitted at least two months in advance.
- ECHA will issue a decision within two months, provided the documentation is complete.
- Without prior recognition, reduced SME fees cannot be applied.
For companies operating within tight commercial timelines, this additional step may directly affect market access planning.
Key Implications for Non-EU Manufacturers & Only Representatives
For non-EU manufacturers relying on an EU Only Representative:
- SME status must reflect the manufacturer’s full corporate structure.
- SME assessment includes headcount, turnover, balance sheet data, and information from linked and partner enterprises — including parent companies. Group structures must be carefully evaluated.
- Timing becomes strategically important.
- SME verification must be factored into registration planning well in advance. Missing this step could lead to higher fees or delayed submissions.
- Validity period offers a strategic opportunity.
- Once granted, SME recognition will remain valid for three years. This can streamline multiple planned registrations if managed proactively.
How Blue Frog Supports Only Representative & EU REACH Clients
For non-EU manufacturers, regulatory compliance under EU REACH is already complex. The introduction of mandatory pre-verification adds another administrative and strategic layer.
As part of our EU Only Representative and EU REACH registration services, we support clients by:
- Assessing SME eligibility based on full corporate structure.
- Reviewing parent, affiliate, and partner company relationships.
- Preparing and managing SME verification submissions.
- Aligning verification timelines with REACH dossier preparation.
- Advising on fee implications and risk mitigation.
- Managing IUCLID dossier preparation and submission.
- Providing ongoing Only Representative compliance support.
For many non-EU manufacturers, SME verification can raise complex questions – particularly where there are holding companies, private investors, joint ventures, or recent corporate changes. Early assessment avoids costly corrections or administrative disputes.
Early Preparation for SME Verification Changes is Critical
Although the requirement applies from February 2027, companies planning future EU REACH registrations should begin preparation now. Corporate data collection and group structure analysis can take time – especially across international organisations.
For companies intending to appoint an Only Representative, SME eligibility should be clarified as part of the onboarding and registration planning process.
Preparing for 2027 with confidence
The upcoming SME verification changes are designed to improve transparency and predictability. However, they also require proactive planning.
